You cannot read 8:39 without reading 8:38 since 8:39 is a
continuation of 8:38. There verse in 2:256 is referring to disbelievers
in generals while 8:39 is referring to those fighting against you. You
cannot apply no compulsion in religion in the middle of a battle but if
for some reason the person you are fighting has a change of heart you
should cease hostilities against the person.
Regarding Bukhara 1.8.387, it helps to know the context in which
it was said. Without the context, it is hard to talk about it. It would
make sense if it supports 8:39 since that is directed against people
who were actively fighting against the muslims.

8:38. Say to those who have disbelieved, if
they cease (from disbelief) their past will be forgiven. But if
they return (thereto), then the examples of those (punished) before
them have already preceded (as a warning).
8:39. And
fight them until there is no more Fitnah (disbelief and
polytheism: i.e. worshipping others besides Allâh) and the religion
(worship) will all be for Allâh Alone [in the whole of the world ].
But if they cease (worshipping others besides Allâh), then certainly,
Allâh is All-Seer of what they do.
There is no
mention of infidel attack or fighting in those verses, 38 tells
us who and 39 tells us what.
The
codification of 9.29 & 8.39 is found in Reliance O9.8 & 9.9 respectively. O9.8
includes this:
The caliph (o25) makes war upon Jews, Christians, and Zoroastrians
(N: provided he has first invited them to enter Islam in faith and
practice, and if they will not, then invited them to enter the social
order of Islam by paying the non-Muslim poll tax (jizya, def: o11.4)
-which is the significance of their paying it, not the money
itself-while remaining in their ancestral religions) (O: and the war
continues) until they become Muslim or else pay the non-Muslim poll
tax...
Chapter 30 of Risala says it is preferable to invite to Islam before
attacking unless the infidels attack first.
Hedaya 2.141 says that Destruction of the sword is
incurred by infidels
although they be not the first aggressors. page 143 echos the
requirement of prior dawah found in Reliance & Risala.
The making of war is contingent on first issuing dawah. It is clearly
on Islamic initiative, offensive, not defensive. See also: Muslim 19.4294.
