This is number fifteen in a series on offensive Jihad in Fiqh. [ Emphasis added for clarity. ]

Fadl-Ullah bin Ruzbihan Isfahani, d. 1521, shafi’i. Suluk ul-Muluk (övers. Muslim Conduct of State, Lahore 1974)

A brief account of the duties which are obligatory on the Imam and the Sultan with regard to (their offices of) the Imamate and the Sultanate. (s. 61) His sixth duty is to fight with those who opposed Islam. But before taking such action he should invite them to surrender and if they refuse then fight with them until they surrender or are obliged to compromise. (s. 62) You must be aware, that the literal meaning of Jihad is ”to strive” or ”to endeavour according to one’s ability and strength.” But in the religious sense it means ”to strive in war against the non-believers according to one’s ability and strength.” (s. 455) You must be aware, that Jihad against the non-believers is an obligation. As regards the Hanafite opinion it has been cited in the Hidaya that Jihad is a duty in general on all the Muslim community. If a group of Muslims observe this duty the rest of them are exempt from it; and if none of them observe it the whole community commits a sin for their negligence. Whenever there is a general call for Jihad it will become a duty for all. A general call may be put in this way; that, on account of the strength of the non-believers, an Imam calls all the Muslims to arms so that they may drive the non-believers out of the land of Islam. The fight against the non-believers is an obligation even if they do not commence fighting. But the Jihad is not lawful against children, slaves, women, the blind, the crippled and he who has not come to the battle-field. If enemies invade one of the lands of Islam, the Jihad will become an obligation to all Muslims for their self-defence. (s. 462) As regards the Shafi’ite laws of Jihad, it has been cited in the Anwar that during the lifetime of the Prophet, the Jihad was an obligation in general on all the Muslim community. In our days there are two kinds of Jihad as it is an obligation on each and every Muslim and at the same time an obligation in general on all the community. Whenever the non-believers invade one of the lands of Islam or besiege one of our towns with the intention of its conquest, it is the duty of the inhabitants of that town to repel the invaders at any cost. (s. 463) The second kind of Jihad is an obligation in general on all the Muslim community. For example, if the non-believers who are well-established in their own country intend to fight against the Muslims, and they refuse to check them, the whole community commits a sin. But if some of the Muslims, whose strength is sufficient to repel the enemy, come forward, the rest of the Muslims will be exempted from Jihad. The sufficiency is achieved by two means. Firstly, the Imam should block the incursion of the non-believers by appointing a group of the soldiers well enought to face the non-believers on the opposite side. Moreover, he should build forts, dig trenches and take similar other steps. […] Secondly, the Imam himself should lead incursions into the Dar-ul-Harb or send someone capable of carrying out this business. The minimum number of incursions in a year is one. It is not permissible to abandon Jihad and let a year pass without an incursion except, God forbid, for the reason of weakness in the Muslims, the large number of the enemies and finally the lack of fodder for the horses on the way. (s. 464-5) It has been cited in the Hidaya that whenever the Muslims invade a Dar-ul-Harb and besiege a town or fort they should first of all invite the besieged to embrace Islam. If they accept Islam the Muslims should give up fighting. If they refuse to accept Islam they should be asked to pay the Jizya, but this choice is only for those non-believers on whom the Jizya may be imposed. The Jizya should not be imposed on the apostates and Arab idolators. There is no need for collecting Jizya from them. (s. 466) When [Muhammed] used to despatch an expedition, he used to advise the commander that before starting to fight he should lay a choice before the non-believers, either to accept Islam or leave that place. If they refused to accept Islam, they should be asked to pay the Jizya. If they refused all these terms, seek help from God the Excellent and start fighting. (s. 474)

This damnable dedication to eternal warfare makes Islam intolerable. The world must be rid of it!

This is the fourteenth in a series of posts on Jihad in Fiqh.

Further, the Imam-Ahmud (on whom be peace!) has related on the authority of Al-Mikdad that he heard the Prophet (for ever blessed) to exclaim: There shall not remain a dwelling in the city, or on the plain, on which Allah shall not cause to descend the word of Islamism, which shall dignify him [who is] already righteous, and condemn him who lives in sin, to the salvation of the one, and the everlasting ruin of the other. For those whom Allah would exalt, will he make of the number of true believers, whilst, those whose destruction has been predetermined, shall seal it by rejecting this holy faith, which indeed, said I, has Allah for its author and its end. Now be it known, that Allah most high bath willed, that the faith of Islamism should flourish throughout the chief of the inhabited regions of the earth; in some countries making the sword and compulsion the means of its dissemination, in others preaching and exhortation. […] Know then, that infidels shall be regarded in two distinct points of view. And first: those who are dwelling peaceably in their own countries, and against whom if one person only from any party of Moslems shall go forth to war, the divine co d on this subject will have been sufficiently observed, and the remainder of his brethren are not called upon to proceed against them. But should no one be found thus to offer himself as the holy champion of his party, then it becomes the duty of all to arm. Secondly: The case of infidels who shall invade the territories of the Moslems, as is now the case in the contest in which we are engaged. Now to attack these, becomes an act of paramount duty for every pious Mahomedan, and for all who would support their religion, whether bond or free, male for female, of the city or of the plain, without being dependent on or guided by the consent or refusal of master, husband, father or creditor, or of any other person to whom he or she might in other matters owe obedience; since to engage in this warfare is imperative on every person whether within three days’ journey of the position of the infidels or beyond that distance; should the forces of the faithful not be sufficiently strong to admit of their services being dispensed with.

Take note of the clauses I have emphasized; how Islam is to be spread: by the sword. The concepts of fard kifaya & fard ayn are discussed but not explicitly named in this quote.

Its Shari'ah, Stupid #13

This is the thirteenth in a series on Jihad in Fiqh.

[…] jihad is a fard al-kifaya, that is, that one must begin the fight against the enemy, even when he [the enemy] may not have taken the initiative to fight, because the Prophet […] early on […] allowed believers to defend themselves, later, however, he ordered them to take the initiative at certain times of the year, that is, at the end of the haram months, saying, ”Kill the idolaters wherever you find them” (Q9:5). He finally ordered fighting without limitations, at all times and in all places, saying, ”Fight those who do not believe in God, and in the Last Day” (Q9:29); there are also other [similar] verses on the subject. This shows that it is a fard al-kifaya.

Its Shari'ah, Stupid #12

In this twelfth installment of exploring Jihad in Fiqh, we return to Reliance of the Traveller.

al-Misri, d. 1367, shafi’i. Umdat al Salik (Reliance of the Traveler), 09.1.

Jihad is a communal obligation. When enough people perform it to successfully accomplish it, it is no longer obligatory upon others […] If none of those concerned perform jihad, and it does not happen at all, then everyone who is aware that it is obligatory is guilty of sin, if there was a possibility of having performed it. In the time of the Prophet (Allah bless him and give him peace) jihad was a communal obligation after his emigration (hijra) to Medina. As for subsequent times, there are two possible states in respect to non-Muslims. The first is when they [i.e. Muslims] are in their own countries, in which case jihad is a communal obligation, and this is what our author is speaking of when he says, ”Jihad is a communal obligation,” meaning upon the Muslims each year. The second state is when non-Muslims invade a Muslim country or near to one, in which case jihad is personally obligatory upon the inhabitants of that country, who must repel the non-Muslims with whatever can.

In this quote, we learn that the communal obligation to perform Jihad is annual. Jihad is not an anachronism which can be ignored, it must be performed every year until the entire world is conquered.

If none of those concerned perform jihad, and it does not happen at all, then everyone who is aware that it is obligatory is guilty of sin, if there was a possibility of having performed it.

You should understand that Jihad is mandatory, and that neglecting it is sinful.

Its Shari'ah, Stupid #11

In this eleventh installment examining Jihad references in Fiqh, we can observe the application of Islamic doctrine in the conquest of India.

The Muslim king will not be able to establish the honour of theism (tauhid) and the supremacy of Islam unless he strives with all his courage to overthrow infidelity and to slaugthers its leaders (imams), who in India are the Brahmans. He should make a firm resolve to overpower, capture, enslave and degrade the infidels. All the strength and power of the king and of the holy warriors of Islam should be concentrated in holy campaigns and holy wars; and they should risk themselves in the enterprise so that the true Faith may uproot the false creeds, and then it will look as if these false creeds had never existed because they have been deprived of all their glamour. […] The majority of religious scholars and wise men of early (Islamic) as well as later time have been sure that if Muslim kings strive with all their might and power and the power of all their supporters on this path, the following objects will be attained: the true Faith will gain a proper ascendancy over the false creeds; the True Word will be honoured; the traditions of infidelity and polytheism will be weakened; Musalmans will be favoured and honoured; infidels and men of bad faith will be faced with destitution and disgrace; the orders of the unlawful state and the opposed creeds will be erased; the laws of the shari’at will be enforced on the seventy-two communities; and the enemies of God and the Prophet will be condemned, banished, repudiated, and terrorised.

Muslim Kins and their armies must strive courageously, risking their lives to overthrow Kuffar regimes, slaughter their clerics, capture, enslave and degrade Kuffar. Thus Muslims will be favored & honored, Kuffar will be destitute & disgraced, Shari'ah enforced and infidels terrorised.

Tzipi Livni: Damn Fool

Tzipi Livni, Israel's Foreign Minister, is quoted by The Israel Project as saying this at a press conference with Ban Ki-moon.

Anyone who suggests that Hamas can become legitimate is either a damn fool, a liar or both. Hamas is Islam. Read its Charter. Clues for the clueless:

Islam is perfected, therefore it can only be defiled, never improved. Neither can Allah's word be changed.

• [...]This day, I have perfected your religion for you, completed My Favour upon you, and have chosen for you Islâm as your religion. [...] [5:3]
• [...]This, indeed, is the biggest favor from Allah to this Ummah, for He has completed their religion for them, and they, thus, do not need any other religion or any other Prophet except Muhammad . This is why Allah made Muhammad the Final Prophet and sent him to all humans and Jinn. Therefore, the permissible is what he allows, the impermissible is what he prohibits, the Law is what he legislates and everything that he conveys is true and authentic and does not contain lies or contradictions.[...] Islam Has Been Perfected For Muslims
• 10:64. For them are glad tidings, in the life of the present world (i.e. righteous dream seen by the person himself or shown to others), and in the Hereafter. No change can there be in the Words of Allah, this is indeed the supreme success.
  

Islam is commanded to fight Jews until they are subjugated and extorted; until only Allah is worshiped. The Jihad is prophesied to continue until the last day; when the last Jew will be hunted down and killed by Muslims. Hamas, being Islam, is bound by the same commands and prophesy.

If we can comprehend these fatal facts, why can't Foreign Minister Livni and Secretary of State Rice? There will be peace when the intelligent and moral Muslims have apostatized and the recalcitrant remnant are dead, not until. The time is long over due to quit bitching about Israel's self defense and start cursing Islam's aggression.

Its Shari'ah, Stupid #10

Ibn Taymiyya returns in the tenth installment of offensive Jihad in Fiqh. Its Shari'ah, Stupid, and it is based on the Qur'an & Sunnah. I have added links where possible; click to verify.

In ordering jihad Allah has said: ”Fight them until there is no persecution and religion becomes Allah’s”. [2:189] (s. 21) [2:193] Allah has, in fact, repeated this obligation [to fight] and has glorified jihad in most of the Medina suras: he has stigmatized those who neglected to do so, and treated them as hypocrites and cowards. (s. 123) [9:124-125] It is impossible to count the number of times when jihad and its virtues are extolled in the Book and the Sunna. Jihad is the best form of voluntary service that man consecrates to Allah. (s. 125) Therefore, since jihad is divinely instituted, and its goal is that religion reverts in its entirety to Allah and to make Allah’s word triumph, whoever opposes the realization of this goal will be fought, according to the unanimous opinion of Muslims. Jews and Christians, as well as Zoroastrians (Magians), must be fought until they embrace Islam or pay the jizya without recriminations. Jurisconsults do not agree on the question of knowing if the jizya should be imposed on other categories of infidels; on the other hand, all consider that it should not be required of Arabs [hence they should convert to Islam or be killed or expelled]. (s. 130)

• Muslims are obligated to fight.
• Jihad is glorified.
• Those who neglect it are stigmatized.
• The goal is Islam's triumph.
• Whoever opposes it will be fought.
• People of the Book must be fought to extortion.
• Others must be converted or killed.

Two weeks ago, Ricks reported on a new publication by Army War College research professor Sherifa Zuhur on Hamas and Israel that informs readers that Hamas has been misunderstood due to the misreporting by “Israeli and Western sources that villainize the group.” Zuhur concludes that Hamas isn’t so bad after all, so we all just need to get along and embrace the terrorist group through negotiations — a view apparently endorsed by the Army War College when it published her defense of Hamas.

A second post last week, “Fiasco at the Army War College: The Sequel,” records an exchange between Ricks and defense expert and author Mark Perry. Assessing the academic state of affairs at the War College, Perry informed Ricks:

It’s worse than you think. They have curtailed the curriculum so that their students are not exposed to radical Islam. Akin to denying students access to Marx during the Cold War.

Idiotic treason! Why do we have Muslims deciding the curriculum at our war college? Why are our future military officers being shielded from knowledge of Islam's doctrines & practices? This nation is being run to ruin by analencephalopaths who should be removed from office or hung for treason.

Its Shari'ah, Stupid #9

This is the ninth installment of a series on offensive Jihad in Fiqh.

Ibn Taymiyya, d. 1328, hanbali. Al-Siyasa al-Shariyya, cit. ur Rudolph Peters, Jihad in Classical and Modern Islam, s. 44-54.

Since lawful warfare is essentially jihad and since its aim is that the religion is God’s entirely and God’s word is uppermost, therefore, according to all Muslims, those who stand in the way of this aim must be fought. As for those who cannot offer resistance or cannot fight, such as women, children, monks, old people, the blind, handicapped, and their likes, they shall not be killed, unless they actually fight with words [i.e. by propaganda] and acts [e.g. by spying or otherwise assisting in the warfare]. […] we may only fight those who fight us when we want to make God’s religion victorious. […] This jihad is obligatory if it is carried out on our intitiative and also if it is waged as defence. If we take the initiative, it is a collective duty, [which means that] if it is fulfilled by a sufficient number [of Muslims], the obligation lapses for all others and the merit goes to those who have fulfilled it […] But if the enemy wants to attack the Muslims, then repelling him becomes a duty for all those under attack and for the others in order to help them. So the latter [form of jihad] consists in defense of the religion, of things that are inviolable, and of lives. Therefore it is fighting out of necessity. The former, however, is voluntary fighting in order to propagate the religion, to make it triumph and to intimidate the enemy, such as was the case with the expedition to Tabuk and the lik.

In an AFP report carried by Google, President Elect Obama's designated Secretary of State uttered this cretinous comment in her confirmation hearing.

The security need of Israel is to be permanently and constantly free from attack and the threat of attack. Palestinians are Jews, not Arabs, not Muslims. • Article 15: The liberation of Palestine, from an Arab viewpoint, is a national (qawmi) duty and it attempts to repel the Zionist and imperialist aggression against the Arab homeland, and aims at the elimination of Zionism in Palestine. Absolute responsibility for this falls upon the Arab nation - peoples and governments - with the Arab people of Palestine in the vanguard. Accordingly, the Arab nation must mobilize all its military, human, moral, and spiritual capabilities to participate actively with the Palestinian people in the liberation of Palestine. It must, particularly in the phase of the armed Palestinian revolution, offer and furnish the Palestinian people with all possible help, and material and human support, and make available to them the means and opportunities that will enable them to continue to carry out their leading role in the armed revolution, until they liberate their homeland.

• The Islamic Resistance Movement draws its guidelines from Islam; derives from it its thinking, interpretations and views about existence, life and humanity; refers back to it for its conduct; and is inspired by it in whatever step it takes.

Article Three

• The basic structure of the Islamic Resistance Movement consists of Muslims who are devoted to Allah and worship Him verily [as it is written]: "I have created Man and Devil for the purpose of their worship" [of Allah]. Those Muslims are cognizant of their duty towards themselves, their families and country and they have been relying on Allah for all that. They have raised the banner of Jihad in the face of the oppressors in order to extricate the country and the people from the [oppressors'] desecration, filth and evil.

Article Five

• As the Movement adopts Islam as its way of life, its time dimension extends back as far as the birth of the Islamic Message and of the Righteous Ancestor. Its ultimate goal is Islam, the Prophet its model, the Qur'an its Constitution. Its special dimension extends wherever on earth there are Muslims, who adopt Islam as their way of life; thus, it penetrates to the deepest reaches of the land and to the highest spheres of Heavens.

Article Seven

• [...]The prophet, prayer and peace be upon him, said:

  The time will not come until Muslims will fight the Jews (and kill them); until the Jews hide behind rocks and trees, which will cry: O Muslim! there is a Jew hiding behind me, come on and kill him! This will not apply to the Gharqad, which is a Jewish tree (cited by Bukhari and Muslim). [Sahih Bukhari 4.52.177, Sahih Muslim 41.6985]

Article Eight

• Allah is its goal, the Prophet its model, the Qur'an its Constitution, Jihad its path and death for the case of Allah its most sublime belief.

Article Eleven

• The Islamic Resistance Movement believes that the land of Palestine has been an Islamic Waqf throughout the generations and until the Day of Resurrection, no one can renounce it or part of it, or abandon it or part of it. No Arab country nor the aggregate of all Arab countries, and no Arab King or President nor all of them in the aggregate, have that right, nor has that right any organization or the aggregate of all organizations, be they Palestinian or Arab, because Palestine is an Islamic Waqf throughout all generations and to the Day of Resurrection. Who can presume to speak for all Islamic Generations to the Day of Resurrection? This is the status [of the land] in Islamic Shari'a, and it is similar to all lands conquered by Islam by force, and made thereby Waqf lands upon their conquest, for all generations of Muslims until the Day of Resurrection. This [norm] has prevailed since the commanders of the Muslim armies completed the conquest of Syria and Iraq, and they asked the Caliph of Muslims, 'Umar Ibn al-Khattab, for his view of the conquered land, whether it should be partitioned between the troops or left in the possession of its population, or otherwise. Following discussions and consultations between the Caliph of Islam, 'Umar Ibn al-Khattab, and the Companions of the Messenger of Allah, be peace and prayer upon him, they decided that the land should remain in the hands of its owners to benefit from it and from its wealth; but the control of the land and the land itself ought to be endowed as a Waqf [in perpetuity] for all generations of Muslims until the Day of Resurrection. The ownership of the land by its owners is only one of usufruct, and this Waqf will endure as long as Heaven and earth last. Any demarche in violation of this law of Islam, with regard to Palestine, is baseless and reflects on its perpetrators.

Article Thirty-Four

Palestine is the navel of earth, the convergence of continents, the object of greed for the greedy, since the dawn of history. The Prophet, may Allah's prayer and peace be upon him, points out to that fact in his noble hadith in which he implored his venerable Companion, Ma'adh ibn Jabl, saying:

• O Ma'adh, Allah is going to grant you victory over Syria after me, from Al-Arish to the Euphrates, while its men, women, and female slaves will be dwelling there until the Day of Resurrection. Those of you who chose [to dwell in one of the plains of Syria or Palestine will be in a state of Jihad to the Day of Resurrection.

Without giving a specific quote, AFP reports that Mrs. Clinton rejects negotiation with Hamas until they recognize Israel, renounce violence and agree to abide by previous peace agreements. When will that happen? On the 33^rd day of the month of Never.

By virtue of Caliph Umar's conquest of the Roman Province of Syria in 638, the Levant belongs to Allah and Muslims must maintain possession of it. By reconquering a fragment of her ancient patrimony, Israel disproves Allah's promises and establishes his status as an impotent idol as demonstrated fact. Muslims will never tolerate that insult.

Allah made promises to Moe. One of them is quoted in the charter, in Art 29.

• Allah has decreed: Lo! I verily shall conquer, I and my messengers. Lo! Allah is strong, Almighty. Sura LVIII (Al-Mujadilah), verse 21 [58:21]

Reliance of the Traveller, Book O. Chapter 9:

• O9.0 (O: Jihad means to war against non-Muslims, and is etymologically derived from the word mujahada signifying warfare to establish the religion.
• O9.1 [...]

  As for subsequent times, there are two possible states in respect to non-Muslims.

  The first is when they are in their own countries, in which case jihad (def: o9.8) is a communal obligation, and this is what our author is speaking of when he says, "Jihad is a communal obligation," meaning upon the Muslims each year.

• O9.8: The Objectives of Jihad

  The caliph (o25) makes war upon Jews, Christians, and Zoroastrians (N: provided he has first invited them to enter Islam in faith and practice, and if they will not, then invited them to enter the social order of Islam by paying the non-Muslim poll tax (jizya, def: o11.4) -which is the significance of their paying it, not the money itself-while remaining in their ancestral religions) (O: and the war continues) until they become Muslim or else pay the non-Muslim poll tax (O: in accordance with the word of Allah Most High,

  "Fight those who do not believe in Allah and the Last Day and who forbid not what Allah and His messenger have forbidden-who do not practice the religion of truth, being of those who have been given the Book-until they pay the poll tax out of hand and are humbled" (Koran 9.29),

  the time and place for which is before the final descent of Jesus (upon whom be peace). After his final coming, nothing but Islam will be accepted from them, for taking the poll tax is only effective until Jesus' descent (upon him and our Prophet be peace), which is the divinely revealed law of Muhammad. The coming of Jesus does not entail a separate divinely revealed law, for he will rule by the law of Muhammad. As for the Prophet's saying (Allah bless him and give him peace),

  "I am the last, there will be no prophet after me,"

  this does not contradict the final coming of Jesus (upon whom be peace), since he will not rule according to the Evangel, but as a follower of our Prophet (Allah bless him and give him peace) ).

• O9.9

  The caliph fights all other peoples until they become Muslim (O: because they are not a people with a Book, nor honored as such, and are not permitted to settle with paying the poll tax (jizya) ) [...]

That is Islamic law. It states that the Caliph must make at least one military expedition against Kuffar in every year. This is confirmed by Fiqh.

• Below is what Al-Ghazali actually wrote about jihad war, and the treatment of the vanquished non-Muslim dhimmi peoples (from the Wagjiz, written in 1101 A.D.): …one must go on jihad (i.e., warlike razzias or raids) at least once a year...one may use a catapult against them [non-Muslims] when they are in a fortress, even if among them are women and children. One may set fire to them and/or drown them...If a person of the Ahl al-Kitab [People of The Book - Jews and Christians, typically] is enslaved, his marriage is [automatically] revoked…One may cut down their trees...One must destroy their useless books. Jihadists may take as booty whatever they decide...they may steal as much food as they need...
• Al-Shafi'i (God have mercy on him) said: "The least that the imam must do is that he allow no year to pass without having organised a military expedition by himself, or by his raiding parties, according to the Muslims' interest, so that the jihad will only be stopped in a year for a (reasonable) excuse." He said: "If he did not undertake the sending of enough troops to fight, those who are absent (must) go out, and consider as an obligation that which God (who is praised) said."

Fools, morons, idiots, cretins and the terminally brainwashed will not accept any evidence, no matter how copious nor how well documented. For those few remaining intelligent and open minded people who may read this post, I present links to exegeses: Ibn Kathir's Tafsir, which cites the ayat & ahadith upon which the Qadi's expert opinion is based. The titles alone will suffice for the few having common sense.

• The Command to have Enmity towards the Disbelievers and to abandon supporting Them
• The Command to strike the Enemies' Necks, tighten Their Bonds, and then free Them either by an Act of Grace or for a Ransom

• The Order to fight to eradicate Shirk and Kufr
• The Order to fight People of the Scriptures until They give the Jizyah
• The Order for Jihad against the Disbelievers and Hypocrites

Now you know that anyone and everyone who spews "peace process", "two state solution", "road map","one state solution", "compromise", "settlement", etc. is either a fool or a liar, most likely a liar. Govern yourself accordingly and use common sense when you vote next time, if there is a next time.

Its Shari'ah, Stupid #8

This is the eighth in a series of posts quoting Fiqh concerning offensive Jihad.

Legal war (jihad) is an obligatory social duty (fard kifaya); when one group of Muslims guarantees that it is being carried out in a satisfactory manner, the others are exempted. The jihad becomes a strictly binding personal duty (fard ain) for all Muslims who are enlisted or whose country has been [invaded] by the enemy. It is obligatory only for free men who have reached puberty, are endowed with reason and capable of fighting. Jihad is the best of the works of supererogation.

This Hanbali Fiqh is congruent with the Shafi'ite, compare it to Reliance of the Traveller, Book O9. Take due notice of the following points in this quote.

• Offensive Jihad is a collective obligation, binding on the Ummah until enough men answer the call.
• Defensive Jihad is an individual obligation, binding on all able bodied Muslims of full age and reason.
• Jihad is the best of extra credit good works for Brownie Points from Allah.

This is the seventh in a series of Jihad quotes from fiqh.

Quote:

The destruction of the sword is incurred by infidels, although they be not the first aggressors, as appears from various passages in the traditions which are generally received to this effect. […] When the Muslims enter the enemy’s country and besiege the cities or strongholds of the infidels, it is necessary to invite them to embrace the faith, because Ibn Abbas relates of the Prophet that he never destroyed any without previously inviting them to embrace the faith. If, therefore, they embrace the faith, it is unnecessary to war with them, because that which was the design of the war is then obtained without war. […] If the infidels, upon receiving the call, neither consent to it nor agree to pay capitation tax, it is then incumbent on the Muslims to call upon God for assistance, and to make war upon them […]

So much for Islam's battles all being defensive. The first sentence takes care of that matter completely. The last sentence fills in the blanks. Dawa is extended: extortion or war result if it ain't accepted. When will our government ever learn? Islam is war, not peace!

An email from a state Act For America chapter on the East Coast alerted me to the existence of another red hot video clip. This one, from MEMRI, shows Hamas leaders spewing their genocidal venom prior to Israel's well justified retaliatory strike into Gaza.

It was filmed in Gaza, and narrated by Christian Prince, allegedly sired by Saudi Royalty; his mother immigrated to KSA as a house servant. Christian Prince grew up in the Arabic Culture and studied Islam's texts in Arabic. He knows Moe's Murder Cult from the inside.

In this short excursion into a long subject, Christian Prince makes important revelations about Hamas. You are about to witness the murder of a wedding party which Hamas attacked because they were playing music and singing. For the clueless: "the Qur'an its Constitution" is the key phrase because it establishes the fatal fact that Hamas and Islam are one and the same. Hamas neither adds to nor subtracts from Islam; it is Islam. To erase all doubt, read the Charter of Hamas. You will find Qur'an & hadith quotes therein; they show you the foundation upon which Hamas is erected..

al-Mawardi, d. 1058, shafi’i. al-Ahkam as-Sultaniyyah, övers. Asadullah Yate, The Laws of Islamic Governance (London 1996), s. 28, 60, 77-8, 200-1.

[The caliph must] make jihad against those who resist Islam after having been called to it until they submit or accept to live as a protected dhimmi-community – so that Allah’s rights, may He be exalted, be made uppermost above all [other] religion. […] it is forbidden us to initiate an attack on the mushrikun while they are unawares or at night, that is, it is forbidden to kill them, use fire against them or begin an attack before explaining the invitation to Islam to them, informing them of the miracles of the Prophet and making plain the proofs so as to encourage acceptance on their part; if they still refuse to accept after this, war is waged against them and they are treated as those whom the call has reached.

The Caliph is obligated to attack Kuffar who reject the call to embrace Islam. Keep 8:39 & 9:29 in mind as the foundation of this obligation. The supremacism clause at the end of the first sentence reflects 9:33.

This is the fourth in a series of quotes from the Offensive Jihad Thread of a censored forum.

Ibn Abi Zayd al-Qayrawani, d. 996, maliki. Cit. ur Leon Bercher, La risala ou epitre sur les elements du dogme de la loi d’Islam (Algiers 1945).

Jihad is a precept of Divine institution. We Malikis maintain that it is preferable not to begin hostilities with the enemy before having invited the latter to embrace the religion of Allah except where the enemy attacks first. They have the alternative of either converting to Islam or paying the poll tax, short of which war will be declared against them.

The Malikis issue their invitation to embrace Islam, emulating their Profit, then, if Dawa is rejected, they attack, as per the orders given in Muslim 19.4294.
The quote does not disguise the fact that Islam initiates hostilities, verifying the fact that Islam engages in offensive wars of aggressive conquest.
